1. Scope & Who We Are

This Privacy Policy applies to The CDL Guide, LLC and all of its trade names, doing-business-as names (DBAs), products, and services, including but not limited to:

Collectively, these are referred to in this policy as "The CDL Guide," "we," "us," or "our."

This policy governs the collection, use, disclosure, and protection of personally identifiable information (PII) and other data collected from users ("you" or "user") through our websites, applications, and services (collectively, the "Platform").

By registering for or using our Platform, you acknowledge that you have read, understood, and agree to this Privacy Policy and our Terms of Service.

3. Fair Credit Reporting Act (FCRA) Notice

Important FCRA Disclosure: The CDL Guide, LLC is not a Consumer Reporting Agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. (FCRA). We do not furnish consumer reports to third parties for purposes of credit, employment screening, insurance underwriting, tenant screening, or any other purpose enumerated in the FCRA.

However, because our Platform collects information that could be used to personally identify users — including name, email address, location data, employment history, CDL class and license status, driving experience, and professional background — we adhere to the following FCRA-aligned principles as a matter of policy:

3.1 Permissible Purpose Requirement

We will only collect, use, and disclose personally identifiable information for legitimate, disclosed purposes. We will not sell, license, or otherwise make available user-identifiable information to any party that intends to use it as a consumer report or for any purpose that would require FCRA compliance.

3.2 Accuracy

We take reasonable steps to ensure that data in our systems is accurate. Users may correct or update their personal information at any time through their account settings or by contacting us directly (see Section 12).

3.3 Dispute Resolution

If you believe information we hold about you is inaccurate, incomplete, or unlawfully processed, you have the right to dispute it. Submit a written dispute to privacy@thecdlguide.com. We will investigate and respond within 30 days of receiving a complete dispute request.

3.4 Adverse Action Notice

To the extent any portion of our services could be deemed to involve consumer reports or employment-related determinations, we will provide appropriate adverse action notices as required by applicable law.

3.5 Employment Screening Prohibition

Data collected through The CDL Guide Platform must not be used by employers, carriers, recruiters, or any other third party as the sole or primary basis for employment decisions without obtaining independent, FCRA-compliant consumer reports from a licensed Consumer Reporting Agency.

4. How We Use Your Information

We use the information we collect for the following purposes:

We will not use your personal information for any purpose that is incompatible with those disclosed in this policy without first obtaining your explicit consent.

5. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

5.1 Service Providers

We engage trusted third-party vendors to operate the Platform (e.g., web hosting, email delivery, analytics). These vendors are contractually obligated to process your data only on our behalf, under confidentiality obligations, and in accordance with this policy.

5.2 Employers and Carriers (Job Board)

When you submit a job application through our Platform, the information you provide in that application (name, contact information, CDL class, experience, etc.) will be shared with the prospective employer or carrier to whom you applied. By submitting an application, you consent to this sharing.

5.3 Legal Requirements

We may disclose your information when required to do so by law, regulation, court order, or governmental authority, or when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of The CDL Guide, its users, or the public.

5.4 Business Transfers

In the event of a merger, acquisition, asset sale, or other business transfer, your information may be transferred as part of that transaction. We will notify you before your information is transferred and becomes subject to a different privacy policy.

5.5 Aggregated / De-identified Data

We may share aggregated or de-identified data that cannot reasonably be used to identify you for research, analytics, marketing, and other lawful purposes.

6. Data Retention

We retain personal information for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention periods:

After a retention period expires, data is permanently deleted or irreversibly anonymized.

7. Account Archival & Deletion

7.1 How to Request Deletion

You may request deletion of your account at any time from your account settings by selecting "Archive My Account." Submitting this request places your account in a pending deletion state.

7.2 The 45-Day Grace Period

Once a deletion request is submitted, your account will be permanently and irreversibly deleted 45 days after the request date, unless you cancel the deletion before that time.

During the 45-day grace period:

7.3 How to Cancel a Deletion Request

To cancel a pending deletion, simply log back in to your account at any time before the 45-day period expires. Logging in automatically cancels the deletion request and restores your account to active status. No further action is required.

7.4 What Happens After 45 Days

After the 45-day grace period expires, the following data is permanently deleted:

Certain data may be retained in anonymized or aggregated form, or as required by law (e.g., records of financial transactions, legal hold obligations). Anonymized data cannot be used to re-identify you.

7.5 Data Subject Requests

To request deletion of your data without logging in (e.g., if you have forgotten your credentials), email privacy@thecdlguide.com with your name and the email address associated with your account. We will verify your identity and process your request within 30 days.

8. Security

We implement industry-standard technical and organizational measures to protect your personal information, including:

No method of transmission over the Internet or electronic storage is 100% secure. While we use commercially reasonable measures to protect your information, we cannot guarantee absolute security. In the event of a data breach that affects your rights or freedoms, we will notify you as required by applicable law.

Depending on your jurisdiction, you may have the following rights with respect to your personal information:

10. Children's Privacy (COPPA)

The Platform is intended for adults who are pursuing or currently hold a Commercial Driver's License. In accordance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq., we do not knowingly collect personal information from children under 13 years of age. Individuals between the ages of 13 and 17 must have verifiable parental or guardian consent before creating an account.

If we discover that we have inadvertently collected personal information from a child under 13 without parental consent, we will promptly delete that information. If you believe a child under 13 has provided us with personal information, please contact us at privacy@thecdlguide.com.

11. State-Specific Rights

California Residents (CCPA / CPRA)

Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), California residents have the right to know what personal information is collected, to delete personal information, to correct inaccurate personal information, to opt out of the sale or sharing of personal information, and to non-discrimination for exercising these rights. Virginia Residents (VCDPA)

Virginia residents have rights under the Virginia Consumer Data Protection Act (VCDPA) to access, correct, delete, and obtain a copy of their personal data, and to opt out of targeted advertising and the sale of personal data. To exercise these rights, contact us at the address below.

Texas, Colorado, and Other State Laws

We respect and comply with applicable consumer data protection laws in all states where we operate or where our users reside. Contact us to exercise any state-specific rights not enumerated above.
